TERMS OF SERVICE

By accessing or using Briefance at https://briefance.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

Briefance is an AI-powered tool that helps freelancers and agencies convert client requests into professional project briefs and proposals. The service includes:

• AI-powered analysis of client messages to extract project requirements.
• Smart question generation to identify missing information.
• Professional brief and proposal generation.
• PDF export of generated documents.

You must create an account to use Briefance. You are responsible for maintaining the security of your account credentials and for all activities under your account. You must provide accurate and complete information during registration.

• Free: 3 briefs per month, 30 preview analyses per day.
• Pro ($19/mo): 30 briefs per month, 100 preview analyses per day, proposal generation, custom branding, priority AI queue.
• Agency ($49/mo): unlimited briefs and preview analyses, team collaboration, priority support.

A "preview analysis" is the first AI step in the brief wizard that detects project type and missing information. It does not count against your monthly brief quota, but daily caps apply on Free and Pro to prevent abuse. Per-minute rate limits also apply across all AI endpoints.

Payments are processed by LemonSqueezy as the Merchant of Record. You may cancel your subscription at any time from the in-app Billing page; access continues until the end of the current billing period.

14-day right of withdrawal (EU & Turkey). If you reside in the European Union, the European Economic Area, the United Kingdom, or the Republic of Turkey, you have a statutory right to withdraw from this contract within 14 days of purchase without giving any reason (EU Directive 2011/83/EU Articles 9-16; Türk Mesafeli Sözleşmeler Yönetmeliği Madde 15). To exercise this right, email info@thecodevolt.com with your order number within 14 days of purchase and we will issue a pro-rata refund.

Immediate-access waiver. Because Briefance is a digital service that begins performance as soon as you sign up (AI brief generation, file storage, proposal drafting), at checkout you may consent to begin service immediately and acknowledge that, once service has begun, the 14-day withdrawal right lapses for the portion already consumed. If you do not consent to this waiver, your withdrawal window remains the full 14 days from purchase.

Outside the 14-day window (or after the waiver applies), subscription fees are non-refundable for the partial billing period in progress. Annual plans purchased with a discount are non-refundable after the first 14 days. Credit packs are non-refundable once consumed; unused credits expire only when explicitly stated at purchase.

Important, please read. Every brief, question set, proposal, and analysis produced by Briefance is generated by a large language model and is advisory only. It is a draft. You must independently review, edit, and validate every output before sending it to a client, signing a contract, or otherwise relying on it.

By using the service you acknowledge and agree that:

• AI output may contain factual errors, unrealistic timelines, mispriced scope, hallucinated details, or legally inaccurate language.
• You, not Briefance, are solely responsible for the final content of any brief or proposal you deliver to a client.
• Briefance does not provide legal, financial, tax, or professional advice. AI output is not a substitute for a qualified attorney, accountant, or contract review.
• You will not submit special categories of personal data (health, biometric, political, etc.) as defined by GDPR Art. 9 or KVKK Art. 6.

Briefance does not warrant the accuracy, completeness, timeliness, or fitness for any particular purpose of AI-generated content. All risk from use of AI output rests with you.

You agree not to:

• Use the service for any illegal purpose or to violate any laws.
• Upload malicious content, malware, or attempt to exploit the system.
• Circumvent usage limits or rate limiting mechanisms.
• Resell or redistribute the service without authorization.
• Use automated scripts to access the service beyond normal API usage.
• Upload content that infringes on third-party intellectual property rights.

Your content: you retain ownership of all content you input into Briefance (client messages, answers, etc.). You grant us a limited license to process this content solely to provide the service.

Generated content: AI-generated briefs and proposals are provided for your use. You may use, modify, and distribute them freely for your business purposes.

Our property: the Briefance platform, branding, UI, and underlying technology remain our intellectual property.

Your use of Briefance is also governed by our Privacy Policy.

Briefance is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages.
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
• We are not responsible for business losses resulting from AI-generated content.

You must delete your account at any time from the Settings page. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted within 30 days per our Privacy Policy.

We may update these terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

These terms are governed by the laws of the Republic of Turkey. Any disputes shall be resolved in the courts of Istanbul, Turkey.
